The Supreme Court on Thursday issued notice on the Chandigarh Administration's plea challenging the Punjab and Haryana High Court's decision to quash criminal proceedings against Punjab Chief Minister Bhagwant Mann and other AAP leaders in connection with a 2020 protest that allegedly turned violent and injured police personnel. The Chandigarh Administration argued that the High Court wrongly held there was no unlawful assembly merely because Section 144 CrPC was not in force, and contended that members of an unlawful assembly can be held liable under Section 149 IPC even without committing a specific overt act. The apex court sought responses from the accused and is likely to hear the matter next on September 18.
